biznesprawnik.pl: Regular referral of employees to work - business trip or delegation?

We recently had the pleasure of advising one of our clients who regularly sends their employees to foreign workplaces, especially for assembly tasks. This often raises questions about how to properly classify these trips and how to account for them. It is worth noting that the issue of business travel has been the subject of many court decisions. According to the prevailing position of the Supreme Court, the performance of work in different locations, when the employee has a permanent place of work in those locations, is not business travel. This means that if the employee regularly performs his duties at these locations, it is not business travel. Another important criterion is the area in which the trip takes place. If an employee has a designated area as a place of work in the employment contract and does not leave the area, it cannot be considered business travel. The scope of the employee’s tasks is also a key element. If the employee’s work involves moving around a specific area, then it is not business travel.
