Our article in the pages of “Przedsiębiorca Rolny”: Agri-photovoltaics in question
Dear Sir or Madam,
In the latest issue of the magazine “Przedsiębiorca Rolny”, our article titled “Agri-photovoltaics in Question” has been published. It addresses one of the most pressing issues in the agricultural and renewable energy market – the ambiguous regulations concerning agri-photovoltaic investments.
The publication provides a detailed analysis of the practical consequences of the lack of coherent provisions in construction law and the Act on the Protection of Agricultural and Forest Land for farmers, investors, and entrepreneurs planning the development of installations combining agricultural production with solar energy generation.
The article discusses, among others:
- the lack of a legal definition of agri-photovoltaics in the Polish legal system,
- divergent approaches taken by administrative authorities to classifying PV installations on agricultural land,
- the risk of losing agricultural land status and ARMA area subsidies,
- recent case law of Voivodeship Administrative Courts concerning agri-photovoltaic investments,
- industry proposals for legislative changes and simplification of investment procedures,
- the importance of agri-photovoltaics for energy security and the competitiveness of Polish agriculture.
The authors emphasize that the lack of clear regulations currently leads to significant legal uncertainty and hinders the development of projects that, in many European countries, already constitute a standard element of modern agriculture. At the same time, there is an increasingly visible need to establish unified rules enabling the simultaneous use of land for both agricultural production and energy generation.
