Government bill to amend the law on consumer rights and some other laws

On June 29, the Government bill amending the Law on Consumer Rights and certain other laws was submitted to the Sejm. On July 6, it was referred for the first reading at the Sejm session.

The project concerns the implementation of Directive (EU) 2019/770 of the European Parliament and of the Council of 20 May 2019 on certain aspects of contracts for the supply of digital content and digital services and Directive (EU) 2019/771 of the European Parliament and of the Council of 20 May 2019 on certain aspects of contracts for the sale of goods, amending Regulation (EU) 2017/2394 and Directive 2009/22/EC and repealing Directive 1999/44/EC, with a view to establishing common rules on certain requirements for contracts concluded between traders and consumers for the supply of digital content or digital services and contracts of sale concluded between a seller and a consumer .

DThe directive will apply primarily to contracts under which a trader supplies or undertakes to supply digital content or services to a consumer, and the consumer pays a price or undertakes to pay a price. Given the expansive nature of the changes, which affect virtually the entire business of entrepreneurs providing digital services or content to consumers, it is worth preparing now for the Directive’s entry into force. Above all, entrepreneurs should: prepare new general terms and conditions of contracts, expand the information provided to the consumer before concluding a contract, and establish practices to fulfill the obligations imposed by the EU law.
