The Supreme Administrative Court overturns the Provincial Administrative Court’s ruling – a success for TURCZA Law Firm’s arguments in a building permit case

We are pleased to announce another success for the TURCZA Law Firm, this time in the field of construction law. As a result of a successful cassation appeal filed by a member of our team, attorney at law Łukasz Kwaśnik, the Supreme Administrative Court overturned the judgment of the Provincial Administrative Court, which had previously upheld the decision of the second-instance authority revoking the building permit.

With this ruling, the Supreme Administrative Court confirmed the validity of our arguments and re-evaluated the case, which led to the removal of a ruling unfavorable to our client from the legal system. This case demonstrates the critical importance of precise legal argumentation and consistency in conducting proceedings before administrative courts, particularly in matters concerning investments and the construction process.

A cassation appeal is an extremely important remedy which—when properly prepared—can determine the final outcome of a multi-stage proceeding.
