How to Terminate Co-Ownership of Real Estate?
Co-ownership of real estate can, over time, become a source of disputes between co-owners. A lack of agreement on how the property should be used, sold, developed, or maintained may lead to a situation in which terminating the co-ownership becomes the best solution.
In the latest article on the TURCZA Law Firm’s blog, attorney-at-law Urszula Makówka explains the options available under Polish law and outlines the procedure for terminating co-ownership of real estate.
Depending on the circumstances, the property may be physically divided between the co-owners, awarded to one co-owner subject to an obligation to compensate the others, or sold, with the proceeds distributed among the co-owners in proportion to their respective shares. Co-ownership may be terminated either by an agreement concluded before a notary or through court proceedings.
