Legalization of a building that was built decades ago? An expert advises what to do in such a case

In the case of structures built before 1995, legalization can take place on the basis of the provisions of the previously effective 1974 Construction Law as well as the current 1994 Construction Law, which includes a special procedure for legalizing more than 20-year-old building arbitrary structures (so-called simplified legalization). If a person burdened with an arbitrary construction project expressly indicates that the mode under which he wants to legalize the illegal object is the so-called simplified legalization, such a request is binding on the construction authority. The authority in this situation is obliged to initiate proceedings under this mode and recognize the prerequisites for legalization of the building object precisely on the basis of the provisions governing simplified legalization.
